Introduction
Welcome to edifyathome.com. The following agreement describes the terms and conditions on which edifyathome.com offers you access to our website and auction services.

Before you may become a member of edifyathome.com, you must read and accept all of the terms and conditions detailed in this User Agreement as well as our Privacy Policy. Edifyathome.com is intended to be a valuable, secure, family friendly experience. To this end, we strongly advise you to thoroughly read and understand all of the terms and conditions in this User Agreement before registering. Additionally, we would humbly request that you partner with us to keep edifyathome.com functioning properly and safely. Please report problems, offensive content, or User Agreement terms and conditions violations to us by clicking on the Contact Us button located near the upper right hand corner of our website.

This agreement is effective on October 1st, 2008, for current members, and upon registration and acceptance for new members. Additionally, by accessing www.edifyathome.com you are agreeing to the following terms and conditions contained in the User Agreement as if you had signed a written document containing the same.

General Terms of Use
Any person accessing www.edifyathome.com may not:

Transmit or distribute through www.edifyathome.com any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, false, defamatory, personal or otherwise objectionable material or information;

Transmit or distribute through www.eidfyathome.com any material that encourages conduct that could constitute a criminal offence, give rise to civil liability, or otherwise violate any applicable Federal, State, or Local laws or regulations;

Transmit or distribute through edifyathome.com any spyware, grayware, malware, adware, viruses or other harmful computer code which may harm edifyathome.com or its members;

Collect, modify, copy, or distribute any information or content found on, displayed on, or residing in the www.edifyathome.com website;

Use www.edifyathome.com if your account has been suspended;

Use www.edifyathome.com if you are unable to form a legally binding contract or are under the age of 18;

Post links to or direct members to any other website, business, business opportunity, catalog, or location from auction listings, member profile pages, store pages, or from within the messaging system hosted on www.edifyathome.com;

Spam other members or edifyathome.com email addresses;

Post information requesting donations or fund raising;

Seller Specific Terms of Use
Any member selling on www.edifyathome.com may not:

Post a false description of the condition or authenticity of an item listed;

List for auction on edifyathome.com items which would violate any laws, license agreements, third party property rights, copy rights, or trademarks;

Fail to deliver items purchased from you in a successfully completed auction once your payment terms have been met;

Place a bid on an item that you or another seller has posted with the intent to manipulate or inflate the purchase price of the auction item through secondary accounts, friends, or any other method or third party;

Complete a sale on a listed auction item with another edifyathome.com member outside of the edifyathome.com auction process, inflate or otherwise charge excessive shipping costs, or otherwise circumvent the edifyathome.com fee structure and/or billing process;

List on edifyathome.com auction titles or item descriptions in all capital letters;

Advertise additional unrelated items for sale in a single item auction listing;

Show a pattern of repeated removal of auction listings in an apparent attempt to circumvent end of auction fees;

List an auction on edifyathome.com promoting a lottery, giveaway, raffle, drawing, or prize;

Enter a keyword or brand name list into an auction item description that is unrelated to the item being listed with the apparent intent to attract additional search hits from other edifyathome.com members;

Charge buyers additional fees over or above the end of auction price, any applicable tax, and reasonable shipping charges;

Offer payment methods that you cannot process;

Request cash payments through the mail or any other payment method not offered through the edifyathome.com auction listing interface;

List for auction on edifyathome.com an item that may not be sold on the internet or shipped legally within the United States;

List for auction on edifyathome.com any of the following restricted items including but not limited to: pornographic or "adult" material; alcoholic beverages; tobacco products, movies with a rating above PG13; music with a parental advisory rating, video games with an ESRB rating above T (teen); stolen items; graphic pictures; hazardous materials; lottery tickets, gambling devices, herbal supplements, diet pills, medications, controlled substances; illegal drugs, drug paraphernalia; real estate; items with an applicable safety recall, stocks or securities, intimate apparel, poisons, livestock, animals, pets, used cosmetics, child safety seats;

Buyer Specific Terms of Use
Any member placing a bid on www.edifyathome.com may not:

Fail to complete prompt payment on a winning bid using one of the sellers selected payment options, unless the seller has changed the terms of the auction after your bid was submitted;

Retract a bid once it is placed, unless due to typographical error, in which case you may contact edifyathome.com so that edifyathome.com can attempt to correct the bid amount prior to the auction closing;

Additional Terms of Use
Edifyathome.com does not become a legal party to the transaction between buyers and sellers. Edifyathome.com is not involved in the actual transfer of legal ownership between buyers and sellers. Edifyathome.com does not investigate, control, or warrant the accuracy, safety, propriety, or legality of items listed. Edifyathome.com cannot and does not control or guarantee whether or not sellers will complete the sale of items they offer or buyers will complete the purchase of items they have bid on. Edifyathome.com does not investigate, control, or warrant the accuracy, safety, propriety, or legality of content posted on or external content linked to from www.edifyathome.com. Subsequently, you agree to hold edifyathome.com harmless from any liability, damages, or losses resulting from your interaction with other members, content posted by other members, or external content linked to from www.edifyathome.com. You accept sole responsibility and liability for any losses or damages including but not limited to monetary losses, unexpected or consequential damages, damage to your computer hardware, software, and internet service arising from the use of www.edifyathome.com content or content linked to from www.edifyathome.com.

The availability and security of www.edifyathome.com may be impacted by many unforeseen external factors beyond our control. Therefore, to the extent permitted by law we exclude any implied warranties and are not liable for any loss of revenue, reputation, goodwill or any consequential damages resulting from your use of www.edifyathome.com. Regardless, our liability to you or to any third party is limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to the liability, and (b) $100. Rights of individual users may vary by jurisdiction.

If you are involved in a dispute with other members, you will not hold edifyathome.com liable for any claims, demands, or damages (direct or consequential) of any kind arising out of or connected with the dispute.

You will hold edifyathome.com harmless from any claim, demand, or fees made by a third party due to their breach of this User Agreement, any law, or rights held by a third party.

As a condition of using www.edifyathome.com you agree to comply with all federal, state, and local laws, statutes, ordinances or regulations regarding any use of www.edifyathome.com including but not limited to the sale and purchase of auction items.

In order to allow edifyathome.com to display your content, when you post content to www.edifyathome.com you give edifyathome.com non-exclusive, international, perpetual, irrevocable, royalty free, sub licensable right to exercise the copyright, publicity, and database rights that you have in the content.

Sellers agree to pay in U.S. dollars any fees associated with the use of www.edifyathome.com which are published under the Site Fees link located on the www.edifyathome.com homepage, including all applicable taxes associated with their auction listings. Any amendment to published fees will be posted by edifyathom.com under Site News and will be effective a minimum of 15 days from the posting date.

You agree that edifyathome.com reserves the right to, at its own discretion, terminate any auction or permanently restrict the use of www.edifyathome.com by any member immediately and without notice for reasons including but not limited to a violation of these User Agreement terms and conditions.

The terms and conditions of this User Agreement may be amended from time to time by edifyathome.com. Amended terms and conditions will be effective a minimum of 30 days after being posted on edifyathome.com under Site News.
